This meeting was called in response to a request for a Town Meeting from the “Taxpayers of Carmanville Group” set up by Marilyn Tulk. The meeting was requested to inform council of their dissatisfaction regarding their 2016 assessments and concern that their 2016 Property Tax would be extremely high because of the significant increase in their Property Assessment.
A letter had previously been sent to all homeowners in October informing residents that the budget was not yet done but council would be lowering the mil rate as much as they could to meet the expenses for next year.
The Chair, Councillor Winsor, welcomed residents to the meeting and gave the attached presentation. He then opened up the meeting to the residents to voice their questions and concerns.
Questions and Comments from residents:
What is the mil rate for next year?
Is there a different mil rate for business tax?
Why wasn’t the budget done earlier? Comment: it should have been done by now out of courtesy to the residents.
Why couldn’t the finance committee do the budget? In the past they did the budget.
Why couldn’t the finance committee do the research for this meeting so the budget information could be obtained by the town manager to have the budget done by now?
Why can’t this group (30 residents) sit down with council to do the budget together.
Why am I paying more taxes than my neighbor? Don’t think it’s fair. Because the government is in debt, don’t think it’s fair to put it back on the residents through high assessments and increased taxes.
Why don’t we offer discounts to seniors depending on their income as they can’t afford to pay their taxes? This question was not raised by a senior citizen but a resident who knew how poor they are by the way they are dressed and feel they may be too embarrassed to ask for a discount themselves.
How are the assessments done? Residents do not agree with the assessment process.
Why can’t we find someone else to do the assessments?
Why can’t we find other ways for revenue?
Why did my assessment go up when I didn’t do any changes to my property?
Why can’t council take each resident’s previous assessment and just add on 10% right across the board for the 2016 Property Tax?
Why can’t we do away with the Municipal Assessment Agency?
Why did we pay $13,440.00 to get this assessment done this year?
Why doesn’t the town have a 5 year plan as to how the town will function financially due to the population decreasing drastically as the loan for the new sewer project will still have to be paid.
Why are we putting sewer through the community? May not be the best use of taxpayers money since population is rapidly decreasing.
Why is the debt ratio at 30% in 2014? Thinks council won’t be able to get loans soon because the debt ratio is too high.
How does the town deal with delinquent accounts? What’s the rate/percentage of delinquent accounts?
Will the rink be used this year? Is there anyone in charge of the rink? Is it a paid or volunteer position?
Why isn’t information about travel/training detailed in the minutes – who went and what they learned? Why are we spending $5,000 of taxpayers money if the residents don’t get this information? Comment: maybe the money could be better spent elsewhere.
Sewer on South Side – bad smell in the summer from the beach where the sewer empties into the ocean.
Manhole on Main Street South – resident said there is a safety issue with the manhole on Main Street South – the cover is often off especially when snow clearing – hooked by plow and she was concerned about the safety of her grandchildren – that a child could fall in and drown. She said the incident was reported several times during the past year and the problem has still not been fixed.
What projects or plans do you have planned for the community?
Can we have another meeting when the budget is prepared but not yet adopted so it could be reviewed by this group before it is actually submitted to Municipal Affairs?
Response to the above questions:
The Chair did explain that the budget has not yet been completed so the mil rate for 2016 is not known at this time. The Chair gave different examples of what assessments would be at mil rates of 5.75, 6.0 and 5.0. At 5.0 the current expenditures would not be covered and we must produce a balanced budget. Chair stated that council is hoping to be able to drop the mil rate to 5.75 or 6 mil. He also stated that this does not solve all the problems for people who were hit with the highest assessments but the increase in taxes would be much lower than residents would be paying at the current rate. He further stated that the Minimum Property Tax and Poll Tax would probably have to be increased to be consistent and fair to all taxpayers.
Yes there are different rates for Business Tax.
He stated that the Finance Committee does not have access to the financial information required to initiate the budget preparation as this information is collected from individual taxpayer accounts. Under the Privacy Act and the Municipalities Act, council does not have access to the financial information and files in the town office any more than a member of the public does. He also stated the same reason applied to the question regarding the Finance Committee doing the research for this meeting to allow the town manager to work on the budget information.
With regard to the assessments, under the Municipalities Act, the town has no choice but get the assessments done through the Municipal Assessment Agency. They are mandated by government. Council has no say whatsoever in the assessment process and they must base the mil rate and minimum property tax rate on the assessed value provided by this agency. This process has always been in place and the town pays this agency annually for the service. As to how the assessments are done, you can call and ask them how they arrived at the assessment for your individual property and they would explain it to you.
Government has been working with the Municipalities of Newfoundland and Labrador to enable Municipalities to do away with the Property Tax by implementing a 1% increase in income tax and an increase in sales tax which would be given back to the Municipalities.
The question of discounts to seniors depending on their income. The loss of income through discounts has to come from the rest of the taxpayers.
5 Year Plan due to future population decrease. Council does have a 5 year financial plan which is all we are required to have under the Municipalities Act. Council does not agree with the statements made that the population will be drastically reduced in the next few years and have no doubt that we will remain financially sustained in the future.
Sewer installation. The town has received an overwhelming request for sewer. The waterlines in the ground have surpassed their expected life expectancy and desperately need to be replaced. Current private sewage systems are not conforming to government regulations in their discharge as can be seen in ditches throughout the community. Town sewer is in almost every community these days and the new town sewer will have a treatment plant as required under new federal laws. The sewer system on the South Side does have a problem when the tide is low and it is raw sewage discharging into the ocean. When that system was installed there were no federal laws in place to govern it as there are today.
Delinquent accounts: The Town does have a Tax Recovery Plan and a part time employee hired to work on the delinquent accounts. The Plan includes recovery of taxes by the following means as required under the Municipalities Act:

Collection Agency
Wage Attachment
Rental Seizure
Property Seizure
Small Claims Court
It was noted that Council does not have access to individual names that are in arrears as per the Privacy Act.
Rink. Weather permitting the rink will be open this winter. Deputy Mayor Marlene Peddle has volunteered to look after the rink for the coming winter. Right now there repairs are being made to the rink under a Community Enhancement Program, not using taxpayers money.
Chair also informed residents the Electrical upgrade is now being done at the Rec. Center through the Gas Tax Funding. Some of the interior work will also be completed through the Community Enhancement Program. The remaining renovations will be taken care of by the Rec. Committee.
Training/Travel details in the minutes. The Minutes are an account of decisions made by council at that meeting relating to that Agenda. Training is approved with the budget annually and registration takes place more often than not following the meeting. When council members attends training, it is to become better educated to deal with new requirements and perform more effectively in their role as a council member. In the case of staff training it is to learn how to actually complete new tasks assigned by government and meet the new requirements and deadlines. What they learned does not belong in the minutes unless it is new information directly relevant to the town itself. It would then be recorded in the minutes. Otherwise it deals with the day to day municipal administration in running the town and meeting the requirements set by government. Some of the training is mandatory under the Gas Tax Agreement. To receive this funding, Council and Staff must attend training annually.
Manhole on South Side. Council did not know this was an ongoing problem that had not been corrected. Clerk/Manager stated that she received one call regarding this problem and as far as she knew the problem had been solved. Therefore it was not taken to Council. Council and staff will look into the matter immediately.
Request that the budget be completed together with the 30 residents who were present at the meeting. That request is impossible to accommodate.
Request for another public meeting before the budget is submitted so that it can be reviewed by the residents will be considered by Council.

Public Meeting – November 26, 2015
Good Evening Ladies and Gentlemen:
First let me thank you for coming to this meeting tonight so you can air your concerns and perhaps have some of your questions answered. This meeting came about in response to several residents who requested a meeting to raise concerns about their recent tax assessments which were mailed to you earlier this year. First let me point out these are only assessments and not your property tax for 2016. Council has not finalized its budget for 2016 thus the mil rate is not determined at this point in time.
So that this meeting can run smoothly, we have put some structure and guidelines in place. If you wish to ask a question or make a statement we ask that you come to the microphone and do your presentation from there. To be fair to everyone and allow as many people as possible to participate we ask that you keep your remarks/questions to 5 minutes or less. Council will attempt to respond to your questions and comments if it is possible to do so at this point in time.
We also ask that in addressing the meeting that you be considerate and careful in your choice of words. Accusations and foul language will not solve the issue we face so we ask that you keep this in mind as you pose your questions or comments.
A little background information that might give you some idea of the situation we face as a result of the latest assessment. In 2015 the total assessed value of property was $14,658,100. In 2016 the total assessed value was $22,998,700, an increase of $8,340,600 or 63.7%.
Some examples of how this would affect property tax at the current mil rate of 8.25 are:

We know that these increases are not realistic and the mil rate will be adjusted downward to bring your taxes into a more reasonable rate.
Adjusting the mil rate down is also going to cause significant problems because some residents will pay less than they currently pay. While this might be desirable, it is not fair and the minimum property tax/poll tax might have to be adjusted to deal with this situation. Even with a lower mil rate, some residents will have a slightly larger increase in property taxes because your rates actually doubled. Lowering the mil rate that much would cause significant financial difficulties in presenting a balanced budget as we are required to do under the provisions of the Municipalities Act.

This meeting was called to review information to present at the public meeting which is scheduled for 7 p.m. on Thursday, November 26th, 2015 at Phoenix Academy. The other item to be discussed was the request for a permit to build a shed at 133 Main Street South.
Permit - Request to Build Shed.
Fire and Emergency Services NL were contacted regarding the requirement that accessory buildings be built 8 ft. from the property line or from any other building as council was previously advised that this was a fire regulation.
FES advised that there are no province wide codes pertaining to the above and the specific regulations in each municipality would be included in their town plan. Our Town Plan does not state the 8 ft. requirement. It does state that:
Accessory buildings shall be clearly incidental and complementary to the use of the main buildings in character, use and size, and shall be contained on the same lot.
No accessory building or part thereof shall project in front of any building line.
The sideyard requirements set out in the use zone tables in these Regulations shall apply to accessory buildings wherever they are located on the lot but accessory buildings on two (2) adjoining properties may be built to property boundaries provided they shall be of fire resistant construction and have a common firewall.
Accessory buildings shall have a lot coverage no greater than 7%, up to a maximum of 56 square meters, or a height of no more than 6 meters.
A letter from the neighbor giving permission to the resident to build the shed in the location they had applied for the building permit was submitted to Council.

Arising: Rec. Electrical Update
The Tender Call will be posted in the newspaper on Thursday, November 5th, 2015. Tenders must be submitted to the Town Office and the closing date is November 18th, 2015 at 2:00 p.m.
Christmas Dinner
The Rec. Christmas Dinner will be changed to December 5th, 2015 provided the Fire Hall is available on that date.
Public Meeting Request
General discussion regarding information required for the upcoming Public Meeting. Results will be brought back to the next meeting for further discussion.
Community Enhancement Program
We have received written approval from Minister Keith Hutchings to hire Deputy Mayor Peddle on the Community Enhancement Program provided all other criteria is met and the guidelines are followed. The program is scheduled to start on November 9th, 2015. Councillor Winsor will be available to coordinate the program.

CNWM 2016 Fees/Schedule
New collection fees for 2016 are as follows:
Regular Household Garbage and Recyclables increased to $132.00/tonne; C & D Mixed - $132.00/tonne. C & D Sorted - $25.00/tonne and Collection Fees - $79.00 per household. Non Compliance fee for unsorted waste or black bags – extra $70.00/tonne.
Finance: 3rd Quarter Financial Reports

Public Works: Boil Order Lifted
Discussion regarding notification of Boil Orders to make sure all residents are informed. Clerk/Manager will check with Government Services to determine if we really need a Boil Water Advisory when flushing lines.
Air Exchanger-Chlorination Chambers
Deputy Mayor Peddle will try her dehumidifier at the Chlorination Chambers and bring results back to next meeting.
Town Garage
The part-time Outside Worker has painted the floor and built new shelves to store the tools at the Town Garage.
Fire Dept: Election
Councillor D. Howell brought forward a request from the Fire Department to hold an election. The Fire Chief is appointed by Council so it was agreed to check with the members to see how often they want to hold elections and which other positions they wish to include.
This information will be brought back to council and a policy will be put in place regarding elections.
It was also agreed to remind the members that any concerns or issues they may have should be brought to Council in writing through the Town Office.
